Terms of Service
1. Agreement
These Terms of Service (“Terms”) govern your use of MakeVox, operated by MakeVox (“we,” “us,” or “our”). By creating an account or using the service you agree to these Terms. If you are using MakeVox on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Your Content — You Own It
You retain all intellectual property rights in your creative work. This includes every story, character, outline, story-bible entry, and image you create or upload in MakeVox. We claim no ownership. You grant us only a limited, non-exclusive license to store, process, and display your content solely to provide the service to you. This license terminates when you delete your content or close your account.
We do not use your content to train AI models, sell your content, or share it with third parties for their own purposes. See our Privacy Policy for full details.
3. Your Responsibilities
By using MakeVox you agree that you will not:
- Upload or generate content that infringes any copyright, trademark, or other intellectual property right of a third party.
- Use the service to create, distribute, or facilitate illegal content — including content that exploits or harms children, constitutes harassment or hate speech, or violates applicable law.
- Attempt to reverse-engineer, scrape, overload, or interfere with the service or its underlying infrastructure.
- Share your account credentials or allow others to access the service through your account.
- Use the service to generate spam or to impersonate others.
We reserve the right to suspend or terminate accounts that violate these rules.
4. Subscription and Billing
Plans
MakeVox offers a free tier and paid plans (Standard and Pro). Paid plans provide higher voice-minute allowances and additional features. Current pricing is displayed on the account page and is subject to change with notice.
Where you purchase
Subscriptions can be purchased in two places, and your plan works across both apps either way: purchases made on the web are billed through Stripe, and purchases made in the iOS app are billed through Apple as an in-app purchase. Your subscription unlocks the same account-level plan on web and iOS regardless of where you bought it.
Billing cycle
Subscriptions are billed monthly or annually, in advance — via Stripe for web purchases, or through your Apple account for purchases made in the iOS app. By subscribing, you authorize the applicable billing provider to charge your payment method on a recurring basis at the start of each billing period. For Apple purchases, renewal and payment are handled by Apple under Apple's Media Services terms.
Cancellation
Cancellation is managed where you purchased. Web (Stripe) subscriptions can be canceled at any time through your account settings or the Stripe billing portal. Apple in-app subscriptions are canceled through your Apple account (Settings → Subscriptions on your device); we cannot cancel an Apple subscription on your behalf. In both cases, cancellation takes effect at the end of the current billing period and you retain access to paid features until that date.
Refunds
For web (Stripe) purchases, we do not offer refunds for partial billing periods or unused allowances, except where required by applicable law; if you believe you were charged in error, contact us within 14 days of the charge and we will review it. For Apple in-app purchases, refunds are handled by Apple under Apple's refund policies — request them through Apple (reportaproblem.apple.com); we cannot issue refunds for purchases billed by Apple.
Price changes
Plan prices may change over time. For web (Stripe) subscriptions, any price change takes effect at a future renewal, and we will provide notice as required by applicable law. For Apple in-app purchases, Apple manages price-increase notifications and, where required, your consent to the new price under its own policies before your subscription renews at the new rate.
Free tier
The free tier is provided without charge and may be modified or discontinued at any time with reasonable notice.
5. Intellectual Property — Our Service
MakeVox and its underlying technology, design, and code (excluding your content) are owned by us and protected by intellectual property law. You may not copy, modify, distribute, or create derivative works from our service or codebase without our written permission.
6. Privacy
Your use of MakeVox is subject to our Privacy Policy, which is incorporated into these Terms by reference.
7. Third-Party Services
MakeVox integrates with third-party services including Clerk (authentication), Stripe (web payments), Apple (iOS in-app purchases and App Store services), and AI and speech providers (OpenAI, Anthropic, Google, ElevenLabs, and Deepgram). Your use of those services is also governed by their respective terms of service and privacy policies. We are not responsible for the practices of third-party services. 8. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not warrant that the service will be error-free, uninterrupted, or that AI-generated content will be accurate, complete, or suitable for any particular purpose. AI output may contain errors, hallucinations, or content that requires human review. You are responsible for reviewing and verifying any AI-generated content before use.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF DATA, REVENUE, PROFITS, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Our total liability to you for any claim arising out of or relating to these Terms or the service will not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim or (b) one hundred US dollars ($100).
10. Indemnification
You agree to indemnify, defend, and hold harmless MakeVox and its officers, directors, employees, and agents from any claim, demand, or damages — including reasonable legal fees — arising out of your use of the service, your content, or your violation of these Terms.
11. Termination
We may suspend or terminate your account at any time for violation of these Terms, for non-payment, or if we discontinue the service, with reasonable notice where practicable. You may close your account at any time. Upon termination, your right to use the service ceases; we will delete your content in accordance with our data retention practices described in the Privacy Policy.
12. Governing Law and Disputes
These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the service will be resolved in the state or federal courts located in California, and you consent to the personal jurisdiction of those courts — except that either party may seek injunctive relief in any court of competent jurisdiction to prevent irreparable harm.
13. Changes to These Terms
We may update these Terms from time to time. When we make material changes we will update the “Last updated” date above and, where appropriate, notify you by email. Your continued use of MakeVox after changes are posted constitutes your acceptance of the revised Terms.
14. Children
MakeVox is not directed to children under 13. By using the service you represent that you are at least 13 years old (or the age of digital consent in your jurisdiction, if higher). If you are under 18, you represent that a parent or guardian has reviewed and agreed to these Terms on your behalf.
15. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and MakeVox regarding your use of the service and supersede any prior agreements. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
